As a Seller you may take almost anything in or around your home as long as it is disclosed up front to the Buyer. In many instances you may want to replace the item. No one likes this type of surprise so if you are going to list your home for sale, take a very long look at every attached item or planted to make some decisions. If you want to take it with you, just let everyone know it on the listing sheet.

From a legal standpoint, if it is attached, it is considered a fixture and will transfer with the sale unless disclosed otherwise.
