Property surveillance devices are becoming more common here on the island and we learned some important information. Massachusetts is a dual party consent state. If your home is for sale or rent and has active equipment videoing or taping, it must be disclosed to the agents, buyers or tenants. Specific consent is not needed, but clear notice of the fact is necessary. If you are renting your home the tenant has the right to peace, quiet and unobserved enjoyment. No recording are allowed in any areas that have a reasonable expectation of privacy.
